Terms of service
These terms govern your use of RestoMS, a multi-tenant, local-first restaurant point-of-sale platform. By creating an account or using the platform, you (the operator) accept these terms on behalf of your business and your staff. If you do not agree, do not use the platform.
ACCOUNTS AND CREDENTIALS
Each operator owns and controls its own tenant and is responsible for all activity under it. You create your own staff users and assign their roles. You are responsible for keeping passwords, staff PINs, two-factor secrets and recovery codes, and any manager approval password secure, and for notifying us of any suspected unauthorized access. Passwords and PINs are stored only as hashes and cannot be recovered, only reset.
SUBSCRIPTION, TRIALS AND PLANS
The platform is sold per tenant on a plan that enables a set of modules. Some modules are always on (point-of-sale, catalog, sales, refunds); others are optional based on your plan. A tenant may run on a trial, then move to a read-only state and ultimately a locked state if no active plan is maintained. Billing, pricing, and refunds are handled separately between you and the platform provider and are not processed inside the platform.
ACCEPTABLE USE
You must not use the platform unlawfully, reverse engineer it, circumvent its security or tenant isolation, access any tenant other than your own, or use it to violate the rights of consumers or third parties. You are responsible for complying with applicable tax, receipt, VAT, and consumer-protection laws, including statutory PWD and Senior Citizen discounts under Philippine law.
YOUR CUSTOMER DATA
You are responsible for your own staff and customer data and for collecting it lawfully, including obtaining any required consents. The platform does not store payment card numbers. How we process personal data, our sub-processors, and our retention practices are described in the Privacy Policy.
AI FEATURES
AI features are optional and available only when the AI module is enabled. All AI output is a reviewable suggestion only. It never automatically moves money, changes stock, or places or refunds orders, and a person must review and act on it. AI output may be inaccurate and must be independently verified. When used, certain business data is sent to third-party AI providers; customer names, phone numbers, and emails are excluded. See the Privacy Policy.
OFFLINE USE
The point-of-sale can work offline. Sales may be buffered on the device and synced when you reconnect. Offline operation is allowed only within a time-limited window; when it expires you must reconnect to continue. Data integrity during offline operation is best-effort, and you are responsible for ensuring devices reconnect and buffered sales sync.
INTELLECTUAL PROPERTY
The platform and its underlying engine are proprietary and licensed, not sold. You receive a limited, non-transferable license to use the platform for your own business while your plan is active. You may not copy, redistribute, sublicense, or create derivative works of it.
AS IS AND LIABILITY
The platform is provided "as is" and "as available," without warranties of any kind to the maximum extent permitted by law. To the maximum extent permitted by law, we are not liable for indirect or consequential damages or lost profits, revenue, or data, and our total liability is limited as set out in the full terms.
SUSPENSION AND TERMINATION
We may suspend or terminate access for non-payment, breach, or abuse. You should export your data before any retention period ends; the platform provides export tooling. Most records are soft-deleted and some (such as audit logs) are append-only and are not erased by ordinary deletion.
CHANGES AND CONTACT
